These Terms of Use ("Terms") govern your access to and use of TheMulliganApp™ (the "Service"), operated by TheMulliganApp™ ("we", "us", "our"). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service you represent and warrant that you have the legal capacity to enter into these Terms.
2. Your Account
You are responsible for keeping your account credentials secure and for all activity that happens under your account. Notify us immediately at support@themulliganapp.golf if you suspect any unauthorised access.
3. Subscription & Billing
- Free plan — 3 swing analyses to try the app. No credit card required. No auto-conversion to a paid plan.
- Monthly plan — US$4.99 per month, billed monthly.
- Annual plan — US$49.99 per year, billed annually (equivalent to US$4.17/month).
Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price, until you cancel. You authorise us and our payment processor Stripe to charge your saved payment method for each renewal.
Cancellation. You can cancel any time from inside the app in one tap, or by emailing us. Once cancelled, your subscription will not renew and you keep access to paid features until the end of the current billing period.
Price changes. We may change subscription prices from time to time. Any price change will apply to the next billing cycle after we give you at least 30 days' notice by email. You may cancel before the new price takes effect if you do not wish to continue.
4. No-Refund Policy
All subscription payments are final and non-refundable, including for partially used billing periods. When you cancel, you keep access until the end of the period you paid for, but no refund of the unused portion is issued. This policy does not affect any statutory refund rights you may have under applicable consumer law.
5. AI Analysis Disclaimer
TheMulliganApp™ uses artificial intelligence to analyse golf swings and generate improvement suggestions. The Service is provided for informational, educational and entertainment purposes only. AI diagnoses and recommended drills:
- Are not a substitute for personalised coaching by a certified golf professional.
- Are not medical, physiotherapy, or injury-prevention advice.
- Do not guarantee any specific improvement, score reduction, or outcome.
If you have or suspect an injury, or feel pain when performing any drill, stop immediately and consult a qualified medical professional.
You are solely responsible for how you use the analysis and drills provided by the Service.
6. Intellectual Property
The Service, including its software, algorithms, models, design, text, graphics, logos and the "TheMulliganApp™" name and marks, is owned by us or our licensors and is protected by copyright, trademark and other intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.
7. Your Content
You retain all ownership rights in the swing videos and other content you upload ("Your Content"). By uploading Your Content you grant us a worldwide, non-exclusive, royalty-free licence to host, process, analyse, and display Your Content back to you — solely for the purpose of operating and improving the Service, and only for as long as it's necessary to do so.
You represent and warrant that (i) Your Content is yours to upload, (ii) it does not infringe anyone else's rights, and (iii) it does not include content of children under 13 or of any person who has not consented to being filmed.
8. Prohibited Uses
You agree not to:
- Reverse engineer, decompile, or attempt to extract our AI models or source code.
- Scrape, harvest, or otherwise collect data from the Service through automated means.
- Use the Service to violate any law or the rights of any third party.
- Upload malware, or attempt to disrupt, overload, or gain unauthorised access to the Service.
- Resell, sublicense, or otherwise commercialise access to the Service.
9. Termination
You can terminate your account at any time — see our Privacy Policy for account-deletion instructions. We may suspend or terminate your access if you materially breach these Terms, if we're required to by law, or if we discontinue the Service. Sections that by their nature should survive termination (Intellectual Property, No-Refund, Disclaimers, Limitation of Liability, Governing Law) will survive.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that the AI diagnosis is accurate, complete, or reliable, or that it will produce any specific results.
11. Limitation of Liability
To the maximum extent permitted by law, in no event will TheMulliganApp™, its affiliates, directors, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) US$50.
12. Indemnity
You agree to indemnify and hold harmless TheMulliganApp™ and its affiliates against any claims, damages, liabilities and expenses arising from your misuse of the Service or your breach of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes we'll update the "Last updated" date and, where appropriate, notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales, unless a mandatory local law grants you the right to bring proceedings in your country of residence.
